A. PURE Services

  1. This PURE Agreement and its Terms & Conditions (Cardholder Agreement or Agreement) is between you and PURE International (HK) Limited, and applies to your access and use of the fitness and yoga facilities and services provided by PURE International (HK) Limited and its affiliated companies (the PURE Group or PURE) at PURE locations in Hong Kong (Locations) where you have registered the service package type you have chosen above (Package).
  2. PURE's services include the provision of training sessions, classes programs and activities, and the use of facilities (including gym space, exercise equipment, swimming pool, and other amenities) at the PURE Locations, through various PURE online and media platforms, and at specially organised PURE events (collectively the PURE Facilities).

B. General Conditions of Use

  1. On completing the registration of your Agreement in PURE's system you will be issued  a PURE Cardholder number that confirms your status as a registered user of the PURE Facilities (Cardholder). As a Cardholder, you must use the PURE Facilities in accordance with:
    1. The type and duration of your Package;
    2. The terms and conditions of this Agreement; and
    3. PURE’s User Policies, which include but are not limited to, all of  PURE’s rules, regulations, policies, guidelines, and FAQs. They also include information on class or activity schedules, bookings etc., that apply to the operation and use of the PURE Facilities. The User Policies constitute a part of this Agreement and are available at PURE Locations, on the PURE 360 Lifestyle app, and on PURE's various websites and media platforms.
    4. PURE reserves the right to revise the User Policies from time to time, including but not limited to rescheduling, cancelling, replacing, discontinuing, or charging additional fees for scheduled classes and activities and the use of any exercise equipment at the Facilities.
  2. You must produce your PURE Card to gain admission to the PURE Facilities. To ensure the safety and security of our facility, we require all entrants to provide a valid government issued photo ID for identification purposes at each entry. Alternatively, you agree to allow PURE to take a photograph to retain for the purpose of verifying your profile as a Cardholder. PURE reserves the right to refuse access or charge you a guest fee for the use of the PURE Facilities for that day, if these requirements are not met.
  3. Cardholders under 18 years of age may use the PURE Facilities only if they are 14 years old or above provided that a parent, guardian or co-signer has signed the appropriate consent form. The use of the PURE Facilities by Cardholders within this age group may be restricted by PURE if it is deemed unsafe or inappropriate.
  4. PURE reserves the right to change your chosen Location to another similar PURE Facility in the event your chosen Location is temporarily or permanently closed, or under maintenance, or renovation. If PURE closes your chosen Location permanently and there is not another PURE Facility within 10 kilometres of your chosen Location, this Agreement will terminate on the date of permanent closure, and you will be entitled for a refund of any unused fees. You are not entitled to a refund if there is another similar PURE Facility within 10 kilometres of your chosen Location.
  5. Your rights under this Agreement are personal to you and must not be assigned or transferred to another person.
  6. Any agreed amendments to this Agreement and your Package (including upgrades, downgrades, renewals, transfers, reactivation etc.) will usually be processed and registered in PURE’s system within 3 working days (subject to all required documents being provided).
  7. PURE reserves the right at its own discretion to reject your application for use of the PURE Facilities.

C. Personal Training Sessions & Other Activities

  1. PURE provides personal training programs/sessions (including fitness, yoga, and nutrition), and other special training programs or activities (personal or group) that are separate from your chosen Package under this Agreement and participation in such sessions may be subject to additional agreements, fees, and User Policies that are supplementary to this Agreement.

D. Guests

  1. You may introduce guests to use the PURE Facilities provided that any such guest completes an Application Form provided by PURE and pays the guest fees prescribed by PURE. We reserve the right, at our sole discretion, to reject such guest’s application to use the PURE Facilities.
  2. When using the Facilities your guests must agree to abide by the conditions of use and to be subject to the same limitation of liability as you are under this Agreement.

E. Your Physical Condition and Safety

  1. Participating in PURE’s physical training activities and use of the PURE Facilities may impose extreme physical demands upon you. You fully understand that it is your own responsibility to ensure that you have the ability to safely participate in the physical training and other activities that PURE provides and to safely use the PURE Facilities. If you are unclear as to your physical capability you should consult a qualified medical professional.
  2. You must not use any of the PURE Facilities or participate in any of the physical activities available at PURE whilst suffering from any infections or contagious illness, disease or other ailment (including but not limited to open cuts, abrasions, open sores or minor infection) as there is a risk that such use or participation may be detrimental to the health, safety, comfort or physical condition of yourself and/or other users of PURE. You must declare and bring any such condition to the attention of PURE staff if in any doubt.
  3. It is essential you are familiar with the use of any of the PURE Facilities and take reasonable care to avoid injuries when using any equipment provided by PURE, including seeking prior advice and assistance from experienced PURE staff on the correct use of the PURE Facilities where you are unuse on their safe and proper use. You must not use any of the PURE Facilities if you are not sure as to their safe and proper use.
  4. Any person who is pregnant, under medication and/or suffering from or having suffered from any medical disability is strongly advised to seek the advice of a qualified medical professional before using any of the PURE Facilities or taking part in any physical activities on the permission of PURE.
  5. Your own fitness monitoring devices, medical devices or other devices may be used by you when participating in PURE’s physical training activities and using the PURE Facilities except where PURE considers that such devices may disturb other members or pose a safety risk.
  6. Persons under the influences of alcohol or prohibited drugs are not permitted to use the PURE Facilities or take part in any physical activities at any PURE Location.

F. Limitation of Liability

  1. You understand and agree that when participating in the physical activities provided by PURE and when using PURE Facilities there is the risk or possibility of injury.
  2. You voluntarily accept the risk of injury involved in the participation and use of PURE Facilities and agree that neither PURE nor its employees or agents shall be held liable or responsible for any injury, death, loss, or compensation for damage to your person or property or to the person, or property of other participants, arising out of or in connection with the use by you or by other users of any of the PURE Facilities.
  3. You agree to defend, indemnify and hold harmless PURE or any of its employees or agents from all claims which may be brought against them for any such injuries or claims and all incidental costs and expenses thereto.
  4. PURE shall not be responsible for any items lost or stolen on its premises. You are solely responsible for taking care of your personal belongings at any PURE Location.

G. Fees

  1. All paid fees described in your Package are non-refundable and non-transferable. PURE reserves the right to impose penalty charges and/or administration fees in the event you commit a breach of the Agreement (including early termination or a request transfer to another user).
  2. Any request to transfer your registered Location to a new Location is subject to PURE’s review and approval and if approved we may impose administrative changes and fee adjustments.
  3. Your Package’s fees or other fees may be increased or reduced, at the discretion of PURE, subject to providing you with reasonable notice of such change.
  4. If you fail to pay your Monthly Autopay Fee on their due date, PURE shall be entitled to:
    1. Immediately suspend your right to use the PURE Facilities and to charge you the following:
      1. Your continuing agreed Monthly Autopay Fees until this Agreement is terminated.
      2. All bank or credit card charges that PURE is charged as a result of your failure to pay;
      3. Interest on the overdue amount at rate of 2% accrued on a daily basis from the due date until the actual date the overdue amount is paid; and
      4. A late payment penalty for each month or part thereof that such fee remains unpaid.
    2. Terminate this Agreement if you fail to pay your Monthly Autopay Fees for 1 month or more after the due date. Such termination shall not affect the right of PURE to recover the unpaid fees and interest and related costs and/or expenses.

H.Termination

  1. Termination of this Agreement by PURE
    1. PURE may terminate this Agreement without notice and with immediate effect if you:
      1. Breach an important term of your Cardholder Agreement or any of the User Policies;
      2. Engage in conduct we reasonably consider is injurious or detrimental to the reputation or interests of PURE or to any other Cardholder or guest;
      3. Commit an act that is in breach of the laws and regulations of the Hong Kong SAR; or
      4. Engage in a dispute or make a claim of any nature against PURE that we disagree with and that cannot be resolved after reasonable attempts have been made by us to resolve the dispute or claim in good faith with you.All decisions made by PURE under this clause are final and binding.
    2. PURE shall be entitled to terminate this Agreement if you fail to pay Monthly Autopay Fees for 1 month or more after the due date by giving written notice to you. Such termination shall not affect the right of PURE to recover the unpaid fees and interest and related costs and/or expenses.
    3. In the event of termination of this Agreement by PURE, you shall lose all rights and privileges under this Agreement with immediate effect without claim for any refund of your Initial Joining Fee, or Monthly Autopay Fee for the month in which the termination occurs. On termination of this Agreement, you must settle any outstanding debts owing to PURE.
    4. PURE shall also be entitled to recover from you all costs and expenses incurred in connection with the recovery of the unpaid fees and interest and other losses or damages caused by you.
  1. Termination of Prepaid Packages by You
    1. If you have a Prepaid Package, your Agreement will end automatically once you have completed your Prepaid Period (unless you renew your Agreement before the expiry of the Prepaid Period).
    2. You are not permitted to cancel your Agreement during the Prepaid Period.
  2. Termination of Monthly Autopay Packages by You
    1. If you have a Monthly Autopay Package, you are not permitted to terminate your Agreement during the Minimum Payment Term.
    2. After the Minimum Payment Term, you may terminate your Agreement by giving us written notice (Cancellation Notice) on or before the following Monthly Autopay Package billing cycle:
      1. the 5th day of the month if your Autopay date is on the 16th day of each month; or.
      2. The 20th day of the previous month if your Autopay date is on the 1st day of each month.
    3. Assuming you have fulfilled your Minimum Payment Term, once you submit  the Cancellation Notice within the stipulated monthly deadline, your Agreement will expire 1 month after the next billing cycle begins, either on the  1st  or the 16th day of the month, depending on your billing schedule.
    4. For the avoidance of doubt, if your Cancellation Notice is given after the monthly deadlines indicated above, you will continue to be charged 1 month’s non-refundable Monthly Autopay Fee, and your termination request shall be processed in the following monthly cycle.
    5. If we have not received your termination request in writing, your Agreement will automatically continue after the Minimum Payment Term period by billing you via Autopay each month.

I. Suspension of Cardholder Agreement

  1. You must submit a completed Suspension Request Form (provided by PURE, available on PURE’s website or upon request) to apply for a suspension of your Cardholder Agreement. A Suspension Request Form must be submitted within 5 days of your intended suspension date  and at least 10 days prior to your next scheduled Autopay  date (if you have a Monthly Autopay Package).  Your suspension request shall only be effective upon confirmation by PURE.
  2. Suspension of your Cardholder Agreement must be for a minimum of 1 full month and a maximum of 3 full months. No suspension for part of a month is allowed. You are allowed to suspend your Agreement twice within a calendar year. No backdated suspensions are allowed. A suspension fee will be charged by PURE for the suspension of your Cardholder Agreement except where the suspension is for medical or pregnancy reasons.

J. Lockers

  1. When checking into the PURE Facilities you will be provided with a locker for use during your visit at no cost (Day Locker). You must remove your items from the Day Locker at the end of your visit; otherwise,  you may be charged an overnight storage fee, and PURE may open unemptied Day Lockers and remove their contents.
  2. Lockers should not be used for storage of valuable items and PURE shall not be responsible for loss or damage of locker contents.
  3. Lockers may also be available to Cardholders for rental on a monthly basis (Monthly Lockers). Please refer to PURE’s Locker Use Policy for further details.

K. Personal Data

  1. The personal data provided by you under this Agreement shall be used by PURE strictly in accordance with the Personal Data (Privacy) Ordinance and any other applicable laws and regulations. Such data may be used by PURE for processing applications, managing your Package and related benefits or services during your membership, for the collection of the various fees under this Agreement, and/or to ensure that services PURE provides are delivered in a safe and proper manner.
  2. The personal data given by you under this Agreement may be disclosed to any member of the PURE Group and/or any agent, contractor or person who provides administrative, telecommunications, information technology and other services to PURE only to the extent it is legitimately required for the safe and proper operation of PURE’s business.
  3. You have a right of access and correction of your personal data that we retain in accordance with applicable laws and regulations.

L. Other

  1. Access to services provided by PURE that are not included in your Package may require you to enter in separate user agreements with PURE.
  2. PURE Lost property found on PURE’s premises will be held by PURE for a period of 7 days, after such time PURE shall dispose of the items in any way it sees fit, no claims shall be valid after this period.
  3. PURE’s normal hours of operation are indicated at PURE’s Locations, on the website and in the PURE 360 Mobile App. PURE reserves the right to adjust the normal hours of operation, or to temporarily close a PURE Location (all or any part thereof) for the purpose of cleaning, decorating, repairs, maintenance, for special functions or events, or due to mandatory government closure orders. However, PURE shall endeavor to give reasonable notice of any alteration to the hours of operation or any temporary closure of a PURE Location.
  4. You must not use audio-visual or video recording devices that may cause a nuisance or distraction to other customers on PURE’s premises. PURE reserves the right to prohibit the use of such devices on its premises. PURE Management reserves the right to take photos and video from time to time on our premises for marketing purposes.
  5. Unless expressly approved by PURE, the taking of photographs or video images, or the use of video or other visual functionality devices, is strictly forbidden: (i) in changing rooms; (ii) during any class or group sessions.
  6. PURE may at its sole discretion amend, vary, delete or add to this Agreement and its Terms and Conditions with immediate effect where such change is reasonable for the proper performance of this Agreement. We will notify you of any changes by displaying these in a notice at the Premises, by notification on PURE360 Lifestyle app, emailing you and/or posting this on our various websites or other media platforms where applicable.
  7. This Agreement shall be governed and constructed in accordance with the laws of the Hong Kong SAR.
  8. In the event of any conflict or inconsistency arising between the English and any Chinese version in any rules, notices, or policies that PURE may issue under this Agreement, the meaning of the English version shall prevail.

PURE Agreement Key Terms - Checklist

Admission to a PURE Location

I agree that I must produce my PURE Card and provide a valid government issued photo ID for identification purposes at each entry or allow PURE to take a photograph to retain for the purpose of verifying my profile as a Cardholder. I understand that PURE may refuse access or charge me a Guest Fee for the use of the Facilities for that day, if these requirements are not met.

Monthly Autopay Package and Termination of Agreement

If I have a Monthly Autopay Package, I am not permitted to cancel my Agreement during the Minimum Term. I can terminate my Cardholder Agreement after the Minimum Term by giving PURE written notice (“Cancellation Notice'”) not less than 10 days before my next Autopay Date. My Cancellation Notice must be given by completing and submitting the Request for Termination form to PURE.

Prepaid Package

If I have a Prepaid Package, my Cardholder Agreement will end automatically once I have completed my Prepaid Period. I am not permitted to cancel my Cardholder Agreement during the Prepaid Period. If I wish to continue to be a Cardholder after completion of my Prepaid Period, I must sign a new Cardholder Agreement with PURE.

Suspension

The suspension of my Cardholder Agreement as provided for in the Terms & Conditions and PURE's Suspension Policy has been fully explained and accepted by me. I understand that I am not permitted to backdate any suspension.

User Policies

I understand that I must use the PURE Facilities in accordance with my Package, the Terms & Conditions of this Agreement, and PURE's User Policies (as outlined in the Terms & Conditions Section B of this Agreement).

Lockers

When checking into the PURE Facilities, I will be provided with a locker for use during my visit. I understand that I must remove my items from the Day Locker at the end of my visit; otherwise, I may be charged an overnight storage fee, and PURE may open unemptied Day Lockers to remove their contents. Lockers may also be available to Cardholders for rental on a monthly basis.

Termination Process

Monthly Autopay Package

  1. If you have a Monthly Autopay Package, you are not permitted to terminate your Agreement during the Minimum Payment Term.
  2. After the Minimum Payment Term, you may terminate your Agreement by giving us written notice (Cancellation Notice) on or before the following dates of your Monthly Autopay Package billing cycle
    1. the 5th day of the month if your Autopay date is on the 16th day of each month; or
    2. the 20th day of the previous month if your Autopay date is on the 1st day of each month.Your Agreement will then expire 1 month after the start of the following billing cycle starting on the 16th day of that month or the 1st day of the following month as the case may be.
  3. If we have not received your termination request in writing, your Agreement will automatically continue after the Minimum Payment Term period by billing you via Autopay each month.
  1. If you hold a Yoga Class Package, you cannot cancel your Agreement in respect of such package.
  2. For the avoidance of doubt, if your request to terminate is given after the dates indicated in Clause 2 above, you will be charged 1 month's non-refundable Monthly Autopay Fee, and your rights and privileges under your Agreement shall expire 2 months after the last Autopay deduction.

Prepaid Package

  1. If you have a Prepaid Package, your Agreement will end automatically once you have completed your Prepaid Period (unless you renew your Agreement before the expiry of the Prepaid Period).
  2. You are not permitted to cancel your Agreement during the Prepaid Period.
