Refunds/Cancellations

• No refunds or credits will be issued for cancellations and refunds due to personal reasons after successful booking as this itinerary is a customised route with limited availability.
• Full payment is required to secure the spot. If registrant is unable to attend for personal reasons after booking, they may transfer their spot to a third party and must provide the new participant’s details.
• Any spot transfer must be approved by PURE

Visa Entry & Requirements

• Compliance with all visa and health requirements for China (Applies to non-Chinese citizens only).
• PURE is not liable for any illnesses, delays or costs resulting from your failure to meet these requirements.
• Your passport or Mainland Travel Permit for Hong Kong and Macao Residents is valid for at least 6 months
• Check with the Chinese Visa Application Service Center for any specific nationality entry updates.

Travel Insurance
Travel Insurance is not included in the package; therefore, we highly urge you to arrange your own travel insurance.

By registering for this programme and signing below, you voluntarily understand and accept the following terms and conditions as set out below.

I am aware that I am responsible for my own travel insurance and have been advised by PURE (Travel) Ltd. that this should be purchased.

I, a participant of this programme, am aware that participating in the retreat requires a certain level of fitness and general physical health. I acknowledge and voluntarily assume my responsibility to assess my level of fitness and general health (including where appropriate consulting my physician or doctor) and the risks of serious injury that are associated with physical activity of any kind including any variety of yoga, meditation and breath work practice and participation in yoga-related activities or activities related to this Programme (the “Activities”). I confirm that I shall retain all control and direction over my Activities at all times. I voluntarily assume full liability and accept the risk of harm, including physical injury and discomfort as a result of my participation in the various activities in this programme.

I also agree to inform the instructor of any movements which I cannot safely perform, and I will not perform any activity or movement, which I feel is likely to cause me to injure myself. I will inform the teachers and/or assistants of any limitations or medical conditions that may affect my practice.

I, or anyone who could claim in my name or on my behalf, my heirs and legal representatives, do hereby voluntarily waive, release and forever discharge the organisers, co-organisers and Resort and its officers, employees, representatives and agents from any and all liabilities for injuries, damages or death resulting from my participation in the activities during the course of this programme as outlined in the programme schedule or any activities outside of the programme and resort facility, and hold them harmless from all claims which may be brought against them for any such injuries or claims as aforesaid and all costs and expenses incidental thereto.

I agree that organisers & co-organisers reserve the right to accept or kindly decline the application of a participant at any time, to make changes in the itinerary whenever reputed necessary for the comfort, convenience, and safety to all participants, and to cancel a trip at any time. In the case that the event is cancelled or postponed, organisers & co-organisers shall have no responsibility beyond the refund of money or expenses paid by the participant if the event cannot be re-scheduled.

I agree that organisers & co-organisers shall not be liable for any cost or expenses for any delay, change in schedule including – but not limited to – delays, missed flights, failure to comply with visa or health requirements of the city, re-scheduling, and/or cancellations or overbooking of flights, loss, damage, or injury to property or persons including death, or expenses occasioned by any act of omission by any supplier providing services to any programme participant.

I agree that Arrow Travel Agency Ltd. & PURE (Travel) Ltd. shall not be liable for any loss, injury, or damage to personal property, or otherwise due to any force majeure event Arrow Travel Agency Ltd. & Pure (Travel) Ltd. has the sole and absolute discretion to cancel or shorten the duration of the programme in the event of acts, events, omissions or accidents that are beyond the reasonable control of Arrow Travel Agency Ltd. & PURE (Travel) Ltd. such as (without limitation) any abnormal, inclement weather, fire, explosion, earthquake, subsidence, structural damage, epidemic or other natural physical disaster, failure or shortage of power supplies, military operations, public disorder, industrial action, act or threatened act of terrorism and/or any legislation, regulation, ruling, decision or omission (including failure to grant any necessary permissions) of any relevant authority, including any court, government agency or governing body. If by reason of any of the events specified above Arrow Travel Agency Ltd. & PURE (Travel) Ltd. and/or the Resort are prevented from performing any obligations hereunder such delay or non-performance shall not be deemed to be a breach of any such obligations and no loss or damage may be claimed by you Arrow Travel Agency Ltd. & PURE (Travel) Ltd. and/or the Resort.

Photo Release
I hereby understand that photos and videos may be taken of this programme and may be used for the production of related promotional materials for PURE Yoga and give consent to this.

Where there is conflict between the English and the Chinese versions, the English version shall prevail.

In this Agreement:

Clauses

1. Fees
   1. You are only entitled to attend the Event when you have paid the fees in full.
   2. Please refer to the description of the refund and cancellation policy of your selected Event on the website
2. Your Physical Condition and Safety
   1. You understand, agree and undertake that:
      1. participating in the agreed Event imposes various types/levels of physical and mental demands and Risk of Injury and you must disclose to us any Existing Condition that you are aware of.;
      2. PURE representatives are not trained and qualified medical professionals and you shall not rely on any physical assessment by PURE as professional medical advice, or to use such assessment by PURE as the basis of any injury or health claim against PURE arising from the Event;
      3. it is your ultimate responsibility to assess, and satisfy yourself, that you possess the fitness, skill and health levels adequate to safely undertake the Activities (including seeking professional medical assessment and advice yourself) and to use any Equipment;
      4. you shall not perform any Activity if, in so far as you are aware, you possess an Existing Condition that could be aggravated or that could increase your Risk of Injury by your participation in the Activity;
   2. You agree that our Representatives may refuse or discontinue your participation in the Event or Activity if they consider that an Existing Condition may be detrimental to your health or safety.
3. Effectiveness and/or Results of Training
   1. You acknowledge and agree that:
      1. the effectiveness and/or results of the training provided in the Event cannot be guaranteed;
      2. individual results of training provided in the Event may vary depending on your own efforts and cooperation in and outside of the Event; and
      3. no representations, assurances or guarantees of any kind have been made or will be made to you by PURE or any Representative concerning any specific results and/or outcomes of the Event.
4. Nutritional, Dietary or Pharmaceutical Products, Advice and/or Recommendations
   1. You acknowledge and agree that, except for Trainers providing Nutrition training and/or consulting, our Trainers are not qualified to advise you on the suitability of any nutritional, dietary and/or pharmaceutical product (whether sold by PURE or not) and you alone are responsible for the selection of any product you choose to use or ingest;
5. Assumption of Risk
   1. You acknowledge and agree that you, being fully aware of the Risk of Injury, you still intend to participate in the Event on an entirely voluntary basis and agree to assume full responsibility for all Risk of Injury arising out of or in connection with the Event.
6. Waiver and Release of Liability
   1. You waive and release all claims against us and all claims against each Protected Person, whether in contract, tort (including negligence) or otherwise, for any and all Loss you might incur arising out of or in connection with you participating in the Event;
   2. We do not exclude or limit in any way our liability to you where it would be unlawful for us to do so. This includes our liability for death or personal injury caused by our negligence or the negligence of our employees or agents or for fraud or fraudulent misrepresentation.
   3. We will not be liable to you for any indirect or consequential loss including loss of profit, loss of business, business interruption or loss of business opportunity.
7. Indemnity
   1. You agree to indemnify us and each Protected Person and hold us and each Protected Person harmless against all Loss we or they may suffer or incur, whether in contract, tort, negligence or otherwise, arising out of or in connection with any breach by you of this Agreement or your participation in the Event.
8. Recording of Event & Data Collection,
   1. You agree the Event can be recorded and stored by us in order to: (i) assess and improve your training or practice; (ii) evaluate and improve the Event; and (ii) for security reasons.
   2. All online Events provided by PURE are strictly intended for your individual use only and you must not record the Event for public or commercial use. You must obtain PURE’s prior consent if you wish to broadcast the recordings in a public forum or intend to use the recordings for a commercial purpose, and we may charge you a fee in respect of such use.
   3. We will collect and store the personal data you provide for the Event including the information in your application registration form, attendance and payments records, fitness and health records, and other relevant information provided by you during or outside of the Event. This information is used for the purpose of managing your registration and payments, managing the provision of the Activities, our internal evaluation of the Event.
   4. The persona data we collect from you shall be kept confidential and will only be shared by third parties involved in the provision of the Event (such as contractors who provide administrative, technology, payment and/or other support services). Our recording of Event and collection of data from you will comply with applicable data protection laws and regulations.
   5. Providing personal data is optional but failure to provide the personal data requested we request may mean we are unable to process your application or fully personalize your training Activities. You may seek access to and request correction of any personal data we hold about you by contacting our Privacy Officer at privacy@pure-international.com
9. Intellectual Property Rights
   1. All intellectual property used for the provision of the online Events belongs to PURE (including copyright, choreography, trademarks, logos, concept, and branding rights). This includes the intellectual property contained in training materials provided to you outside of the Event such as videos or other training materials. You agree that any intellectual property that is newly created during the online Event shall fully belong to PURE.
10. General Terms
    1. If you are not yet 18 years old but over 14 years of age, your parent or guardian must co-sign this Agreement agreeing to be responsible for you until you turn 18 including responsibility for the payment of your Fees.
    2. This Agreement is governed by the laws of Hong Kong.
    3. This Agreement is personal to you. You may not transfer your rights and/or obligations under this Agreement to anyone else.
    4. You agree that we may terminate this Agreement and your participation in the Event if you breach any Rules or if you engage in any behavior that prevents us from properly delivering the Event.
    5. This Agreement replaces and extinguishes all previous agreements between you and PURE, whether written or oral, relating to the Event. Where you have an existing Cardholder Agreement and/or other agreements with PURE these agreements shall still operate and in the event of any inconsistency relating to the Event this Agreement shall prevail).
    6. By signing this Agreement, you confirm that you have read, understood and agreed to all of its terms.
